In June 2025, David and his team secured a significant result for a client who suffered severe arm injuries after tripping on construction debris at a job site in Virginia. The fall led to multiple invasive surgeries and kept the client out of work for an extended period.
One of the biggest challenges was proving that the client was an employee—not an independent contractor—of the company managing the construction site. Although the client had contracted independently with this same company in the past, the owners had directly recruited and paid him for this particular project. With detailed communications and pay evidence, David built a strong foundation to establish employment status—something necessary for his client to be protected by the Virginia workers’ compensation laws.
Persistence Through Multiple Appeals
When the case first went to court, the defendant’s testimony unexpectedly supported David’s argument. Despite this, the Commission initially denied the claim. Determined to fight for his client’s rights, David filed multiple appeals, working closely with his client to draft detailed briefs and prepare for every step of the process.
Two years after the accident, the appeals process finally produced the outcome David knew was right. The original denial was overturned. “This is the correct decision,” David said. “My client has been out of work since July 2023.”
