Recently, Luke and his team obtained a successful jury trial verdict for a client who suffered severe injuries in a car crash caused by a negligent driver who crashed into the rear of his client’s car.
The crash left the client with serious neck and back injuries, as well as a traumatic brain injury.
The client—a hardworking community member—along with his wife and daughter, were on their way to visit a terminally ill family member at the time of the collision. Since the crash, his injuries have prevented him from doing the things he loves, such as caring for his family, traveling, and completing everyday tasks around the house.
“He worked his entire life up until the point of trial. He wanted to enjoy his retirement the way he had planned, but he couldn’t because of the injuries and the impact they had on his life,” Luke explained.
Overcoming Defense Tactics with Authenticity
One of the biggest challenges Luke faced in this case was the defense’s focus on his client’s treatment gaps. “There was a point when he took a year and a half off from treatment to care for his wife and daughter. The defense tried to use those gaps to question his credibility, thinking it would score points with the jury. But context matters—it wasn’t because he wasn’t injured; it was because he’s a good person who wanted to be there for his family,” Luke said. “When you take the time to truly understand a client’s story from their perspective, the truth always comes out. Things aren’t as black and white as insurance companies like to make them seem.”
Fighting for Fair Compensation
After denying benefits throughout the case, the insurance company made a last-minute offer just one month before trial—but it wasn’t even close to what the client deserved. “That’s a common tactic by the defense—to wait until the eleventh hour to make an offer. In this case, it was $50,000, which was nowhere near the true value of the case. It didn’t take much thought to reject it and move forward with trial, knowing it was the right decision to let the jury decide,” Luke recalled.
After three days in court, the jury delivered a $1.5 million verdict—a result that validated the client’s honesty and unwillingness to just accept what the insurance company was offering him.
“It makes the result even more rewarding because a jury of his peers agreed with how he felt all along. That validation is incredibly satisfying for him,” Luke reflected.
