David Kapson David Kapson prioritizes his clients above all else. When asked why he chose to practice personal injury law, he explained that he feels a strong calling to help others: “I’ve always thought it was the right side to be on – to be helping people.”

In his meetings with clients, David values a crucial aspect of the case-building process: learning. He emphasizes the importance of meeting clients in person to understand the real-life implications of their injuries. David explains, “In our line of work, it’s difficult to operate in a vacuum—looking only at documents and sitting in an office. Being present, understanding a client’s experiences, seeing where they were injured, and grasping the full extent of their situation is vital. For instance, when I sit down with a client who has just undergone major surgery, I can witness their recovery process firsthand. This allows me to see the actual, day-to-day impacts of their injuries, rather than just relying on the black-and-white details of a medical report.”

In August 2024, David and his team achieved a successful outcome for a client who was injured while retrieving items from a freezer as part of her regular job duties. The client slipped and injured her right knee, which required surgery to repair the initial damage from the fall. Unfortunately, after the surgery, her knee problems continued to worsen, ultimately leading to the need for a full knee replacement to fully address the injury.

David and his team represented this client since their injury in 2018. They navigated through the defense put up by her insurance company, conducting several hearings throughout the case. One hearing focused on the treatment for her initial injury, while subsequent hearings addressed the worsening of her condition. Although the defense tried to dismiss her injury as a mere torn meniscus, this was not the only obstacle they had to face.

The defense frequently changed attorneys, leading to variations in their defense strategy. Additionally, the defending insurance company initiated private investigations into David’s client, repeatedly intruding into her personal life in an effort to prove malicious intent. “It was very invasive for her,” David commented.

Ultimately, David and his team successfully secured the medical treatment their client deserved. They began by obtaining a court order requiring the client’s insurance company to pay her the benefits that had been wrongfully denied, along with additional penalties for withholding those benefits. Although David’s team managed to gain coverage for both of her knee replacements, the insurance company then attempted to deny coverage for follow-up maintenance visits, which are standard after joint replacements. In the final stages of their case, David and his team ensured that medical coverage extended not only to the injury and its treatments but also to subsequent maintenance treatments and future care, thus securing a comfortable medical future for their client.

David emphasized the significance of his relationship with the client. “She’s like family to me now,” he said. When collaboration is crucial, building trust becomes essential. “She understands that whenever I make a suggestion, it’s not for my benefit. It’s always because I have her best interests in mind,” David explained.
